General Website Information &

Terminology:

Listed below are a few pointers that may help with the use of the website: If you have an enquiry on any point listed below, use the Contact Us link to post your question.

Most of the site is set up as a virtual shopping cart / ordering system: most of the product pages can be accessed from the links provided by the search engines.

Not all products are available all the time. The site is as much an information site as it is an ordering site. Some high end products may need to be specially ordered from the manufacturer. Contact Us for details.

Nothing is purchased by clicking on the Add button, all this does is add the product to a shopping basket. There are two more steps that need to be completed before the list can be sent to us for processing.

The reverse of your sales invoice contains all your warranty information and our Terms and Conditions. The details on the front of the invoice are what have been used to identify you in our system. If there is a spelling mistake, or an administration mistake, please contact us immediately so that it can be rectified.

Important Terminology: These terms and abbreviations are used throughout the site:

E & OE - Errors and Omissions Excepted (Excused).

We endeavour to keep all information as accurate as possible; however genuine errors will occur from time to time, due to the large scale, number of product lines, and nature of our business.

We have an automated ordering system with payment details being entered at the time the order is placed. However the payment is not actually taken and the order is not accepted by us at this stage. We will first notify customers of any issues with stock / pricing / availability before we process the transaction.

We take all reasonable steps to avoid this happening and we correct any errors as soon as we become aware of them; In terms of contract law – our website is merely an invitation to treat and there is no intention to mislead.

• All prices will be confirmed, and you will be advised of any errors, prior to completion of a sale
• You will be advised of any variations to the listed price prior to the transaction proceeding
• If there is a price increase on an item you have ordered we will not process the order until we have advised you of the change and have your approval to proceed

SRP: - Suggested/Suppliers Retail Price (where one exists) : As set by the official supplier in NZ. All prices are in NZ dollars and include GST.

Our Price:
The price we sell this item for. All prices are in NZ dollars and include GST. Some items might be discounted as part of a price special, others may be discounted due to being end of line, shop-demo, floor-stock, missing parts or minor damage. This will be noted where possible.

Pricing Overall:
All pricing is updated directly from our in-store point of sale system on a schedule. Updates are ongoing. In order that our prices are as competitive as possible, Group Product Managers may change prices internally on a daily basis and disparities can occur. The point of sale system is the governing factor in pricing disparities; errors and omissions excepted. You will be advised of any variations to the listed price prior to the transaction proceeding.

Prices indicated on this website are therefore subject to change without notice.  While we make every effort to keep the prices shown on the site up-to-date, there may be occasions when there are price changes from a product distributor that we are not immediately aware of, which may result in a slight delay in the website prices being updated.  If there is a price increase on an item you have ordered we will not process the order until we have advised you of the change and have your approval to proceed. 

$0.00:
 Occasionally a price of $0.00 may be displayed in the website.  This is most commonly found with new items being loaded ahead of goods arriving.  We do not have any free items or $0.00 items.  These are a clerical error and will be rectified as found.  The actual price and availability of these items will be given to you when you contact us.  Any orders with $0.00 items will not be processed until we have contacted you about the respective items.

Discounts: We aim to represent our lowest, most competitive prices at all times on our website, If you feel that our price is higher than that offered by a competitor, please let us know and a senior member of our online team will review this for you.

If you have a discount card through one of many educational initiatives, please note that the discount percentage is off the RRP of the product.

POA – Price on Application: The website shows “up to date” stock and pricing for product that is currently on hand. 

However, due to the vast number of products available to us, the highly specialized nature of some items and our various supply arrangements, we may have sold through, and/or be awaiting re-stocking at that time. In order to keep our listings “live” on the web, our system will log these items as POA (Price/Product on Application). In addition, there may be items awaiting arrival or undergoing re-pricing, or we may not have the latest available price from our supplier. Again these will show as POA. Click on the ‘Click to Apply’ link on the product page.

Purchasing Terms & Conditions
Purchases may be made by credit card, direct credit or pre-approved purchase order.

Direct Credit
For direct credit, once you have placed your order, the screen will display a 9 digit order number which you will need to use when you make your deposit.

The reference number is crucially important as goods will be dispatched on the clearance of funds into our account. 

Credit Cards
We work diligently to protect the security of your personal information, including credit card information. We apply industry best practise and regularly review our processes in line with published updates, technology changes or recommendations from our industry partners.

Your credit card details do not get processed or transmitted through or via NZ Rockshop's website; all transactions are processed through a secure payment service provider. An online approval is the first step in a two step process.  NZ Rockshops uses Direct Payment Solutions (DPS) to provide this service. DPS hosts and manages the secure payment page. Once the final details of the transaction are completed and the goods are shipped, the sale is then completed by a Rockshop staff member for added security; this is the second step in the process.

Your credit card details are not held by NZ Rockshops and cannot be accessed by NZ Rockshops staff.

All credit card sales are for New Zealand based cards only. Overseas ordering is dealt with on a case by case basis due to: Manufacturer restrictions on distribution, security; compliance; tax; warranty and freight issues. Please give full contact details when ordering.

Due to the prevalence of online fraud – and due diligence requirements from our Bank -  all orders received that are over $50 may need to be confirmed. Usually, we will confirm via Whitepages; we may request you supply a recent utility bill (phone, power, gas etc) or whatever other means may be necessary to confirm your details. We will use your supplied email address to communicate with you.

Warranty
The NZ Rockshops warrants to the first purchaser from an authorised Webb Group Dealer in NZ that this product will be free from defects in materials and/or workmanship, is of merchantable quality, fit for the purpose as described, and will perform in accordance with its specification; from the date of purchase, for a period of 12 months (new products); 3 months (used products) and subject to the Warranty Terms and Conditions (click here for full Terms and Conditions).

No other warranties either express or implied by law are made with respect to these goods.

Business Use / Purchases and the Consumer Guarantees Act:
We believe it is important to clarify your rights as a purchaser where there may be a “Business Use” component to the sale. Therefore, please be aware, where the buyer is acquiring the product for the purpose of business then the Consumer Guarantees Act 1993 shall not apply. In this case, the explicit Rockshop warranty will apply subject to the Terms and Conditions noted on the reverse of the Sales Invoice (click here for full Terms and Conditions).

“Business” includes any performance of a public nature - whether paid or otherwise - and includes, but is not limited to, Schools, Churches, Institutions, working musicians, installations, hospitality, and studios. This exclusion also applies for goods purchased for resale or use in repairs or goods used for purposes other than domestic, personal and/or household use. No other warranties either express or implied by law are made with respect to these goods.

Refund Policy:
We do not have to provide a refund if you have changed your mind about a particular purchase, so please choose carefully. If the goods are faulty, we will meet our obligations under the Consumer Guarantees Act to provide a remedy.

Should a refund be determined appropriate, the following conditions apply:

- Refunds are not available from any Branch;
- For the purposes of security and audit trail, only Head Office will process refunds on provision of the appropriate documentation and authorisation
o Documentation will include identification;
o It will be witnessed by an employee and authorised by a Manager
- Refunds will be processed within 7 days of receipt of the paperwork by Head Office or on Friday; whichever comes first

You may chose a credit instead of a refund. This can generally be applied the next working day: Monday – Friday only.

Re- stocking Fee:
Usually when you buy things the contract is final. You don't have the right to return goods and exchange them or get a refund simply because you've changed your mind or your circumstances have changed.

If it is not faulty there is no legal obligation on the store to take it back at all. The following situations are at Rockshop’s absolute discretion.

- Under rare circumstances – and after approval from Head Office – it may be allowed to return unused and unopened Goods.
We will not refund any freight, delivery fee or installation cost and you must pay for us to pick up the Goods if required. Credit card charges will not be refunded.
- If goods are unused but have been unpacked we may, at our absolute discretion, accept return of the goods provided they are in perfect condition.

In either case, Rockshop reserves the right – at its discretion – to apply a restocking fee of up to 20% of the original purchase price.


Finance Figures and Options
We choose to partner with Finance NOW, one of NZ’s leading financial solutions providers. With a solid backing, first class reputation and a range of inventive finance products, Finance NOW and the Rockshop have a solution for your investment including business finance and leasing options.

Weekly Payment Interest Bearing:
All weekly payments are indicative only for that item and are based on a term of XX months at an interest rate of 19.95% and include a $1.75 monthly service fee (effective 17th Oct 2016) and a $55 establishment fee. Details of finance (including weekly payments, the total amount repayable over the term of the loan, interest rate and any applicable fees) can be confirmed with a detailed quote in store. Full disclosure of all of the terms of your finance will also be provided to you in the Finance Now disclosure statement for your consideration prior to confirmation of your purchase. All finance is subject to Finance Now terms and conditions and approval criteria.


Interest Free Version: (during promotional periods only)
All weekly payments are indicative only for that item and are based on a term of XX months, with the first X months interest free followed by X months at an interest rate of 19.95% and include a $2.95 monthly service fee and a $55 establishment fee. Consumer Protection Insurance - Finance

Finance 0% Interest Promotions
From time to time special 0% interest finance promotions are run. They are subject to the following general terms:

1. Minimum purchase $199.
2. Subject to Normal Lending Credit Criteria: all the normal checks and requirements of any contract.
3. Establishment fee and monthly fees apply.
4. Proof of insurance may be required for the HP Agreement (only if the CPI available is not taken) i.e. a copy of your policy or advisement from your insurer.
5. Interest free promotions will have a determined length eg: 1st May – 31st May, 2015
6. Interest free promotions will note excluded products. Additionally, the Rockshop reserves the right to exclude some clearance items or already discounted products from promotions.
7. On conclusion of the 0% interest period, the normal interest charge of 19.95% applies.

 


 Freight - Interbranch/International
The Rockshop is proud of the brands and lines we stock. We have, by far, the biggest and most extensive selection of musical equipment available in NZ with most items in stock in NZ.  However, not all brands, models, types and colours can be represented in every store: These need to be shipped from one location to another. Moving gear around is expensive. We use only the most reputable courier with tracking technology and effective insurance. Rockshop makes this facility available to anyone, recouping a modest amount where necessary to cover our costs on product that is already competitively priced.

Occasionally, your specific requirements cannot be met by items we have in stock and a special order may be appropriate.

The following is a basic guide to our freight options for in-store customers.

We have two methods of moving goods between branches, suppliers, or from our central supply centre. They are PALLET and COURIER.

PALLET – usually free – 5-10 days
COURIER – cost varies – 2-3 days – some restrictions in size

PALLET – involves the goods being sent on the next available pallet (bulk freight). All pallets travel to our supply centre in Auckland where they are repackaged to travel out to the appropriate branch via the next pallet. The cost for this is usually free unless the item is large and / or heavy. You will be informed of the freight cost - should there be a charge - when you place the order. Items travelling via this method should be allowed 5-10 days for arrival.

COURIER
– involves the goods being sent direct to you via courier. This is usually Courier Post or Toll Freight. The cost depends on the size of the item. You will be informed of the freight charge should there be a charge when you place the orders. Items travelling via this method should be allowed 1-3 days (not including weekends or additional rural delivery time). They can be sent to an address of your choosing or your local branch for collection

If you are getting something into VIEW via courier and you decide not purchase it, the transfer fee / freight charge is not refundable.

Your Local Branch Manager’s discretion applies on all points and at all times.

Freight / Shipping Information – Website Purchases:
The website online ordering system uses a guide for pricing out freight on orders, however different items have different costs and the costs will be dealt with individually to ensure fair and reasonable charges. You will be contacted if there is a cost increase on your order.

If there is a refund on the freight charge, it will be issued to you where appropriate.

Freight charges cover the freight cost as well as the packaging.

Delivery Time:
The delivery time for orders placed on the website is noted above. If you require delivery by a certain date (birthday present etc) - please add a comment in the COMMENTS section on the order form to this effect.  We see this information more quickly than a separate email.

If your order is received by 1:00 PM on a business day it will usually be shipped the same day if possible.  Orders received after 1:00 PM will be usually shipped on the next business day. 

With the number of physical locations we have Nationwide, stock may have to be relocated from one city to another before being shipped to you. We will endeavour to notify you of any expected delays.

If extra information is required to process your order, such as credit card verification, this can delay the sending of your order. If you have ordered an item that is out-of-stock or sold-out, we will attempt to contact you immediately. A delay may also occur if your credit card was declined; for address verification;  if your billing address was entered incorrectly; or if order details were omitted.

Please note that delivery times are target times and are not guaranteed by the courier company and can sometimes take longer. If you require a product urgently, please don't leave it to the last minute to order.

PLEASE NOTE: Rural and some residential areas may require additional delivery time.  Rural Delivery, for example, can take 2-3 days longer than a normal delivery.  So a rural delivery can be up to 6 business days.

 


General Terms and Conditions: Gift Cards & Vouchers
Gift Cards, and any website issued Gift Vouchers (in testing currently), are subject to the following General Terms and Conditions:

1. Gift Cards & Vouchers are not redeemable for cash;
2. Gift Cards & Vouchers are not refundable;
3. Gift Cards are valid for 24 months from the date of purchase or the last re-charge (Gift Cards only);
4. Gift Vouchers (Website) are valid for 24 months from the date of purchase;
5. Once expired, NZ Rockshops, KBB Music, or any Webb Group related entity will not be obliged to honour any remaining balance on the card or voucher. It is solely the responsibility of the purchaser to ensure the Card or Voucher does not expire.
6. Any unused value associated with the Gift Voucher ( where the voucher is not fully utilised in payment for goods) will be reissued to a new voucher code and will remain valid until the expiry date stated on the original voucher;
7. Any unused value on a Gift Card remains on the card until used, or the card expires.
8. If your order exceeds the amount of your Gift Voucher or Gift Card, you must pay for the balance with a credit card or other agreed forms of payment at the time of purchase.
9. Each Gift Voucher and Card is identified by an individual code that must not be changed or copied by the purchaser. Damaged or defaced codes will result in the voucher being refused. NZ Rockshops, KBB Music or any Webb Group related entity, also holds the right to terminate any Voucher which they believe is being misused;

10. The Gift Card / Voucher cannot be replaced if lost, stolen, or destroyed.
11. Minimum Gift Card amount – and subsequent recharge – is $20; Maximum Gift Card amount is $1000

GIFT CARD TIP : All Gift Cards have the ability to be re-charged. You can use this to extend the expiry date, or load a card with a specific amount that can only be used at our store.

For example, rather than giving Little Johnny $20 in cash for new guitar strings, his Mother could load the Gift Card with that amount. Little Johnny can only spend it at the Rockshop (and not at the diary for a pie and a can of V).

If the expiry date is drawing near and you don't want to lose the balance on it, but aren't ready to purchase, you can recharge the card with a minimum of $20. This will extend the expiry date of the ENTIRE BALANCE for another 24 months from the date of the successful recharge.

 


 

Deposits / Pre-Orders

In the event that an item requires a deposit in order to secure it for you, this deposit amount will be 25% of the RRP.  In some cases, this deposit may be non-refundable and this can be for a variety of reasons.  We will let you know before you make your payment, if the deposit is non-refundable.

The balance of the sales price will be required to be paid upon collection, or an approved finance contract arranged.

Information we collect:
Whenever you access this website, NZ Rockshop may collect the following types of information from you:

2. The operating system and the browser your computer uses and any search engine you are using;

Email:
It is the policy of NZ Rockshops to send our clients emails throughout the purchasing process and other Newsletter emails they elect to receive. Further, it is our policy to immediately remove any client from any mailing list upon the client’s request. In addition, NZ Rockshops will send out promotional material to its Newsletter subscribers promoting material, clinics or events related to NZ Rockshops.

 

We do use email as a means of receiving feedback from our members, and we encourage you to Contact Us with your questions or comments.

Emailing Tools:
NZ Rockshops provides tools on its website to tell a friend about products and send out wish lists. These tools must not be misused in any way to send spam or other content which would violate our Privacy Policy or Terms and Conditions. We do not permanently store, sell, or rent, these email messages or the email addresses.

Spam
Occasionally we receive reports from some of our customers that they believe our email database has been compromised and we are leaking their email addresses to spammers. Some of these customers have set up an email address that is only used for our emails and they cannot understand why they are receiving spam emails as well.

We have never - and will never - give out our customers email address or account details. We consider the practise to be both immoral and illegal. We are continuously monitoring our client database through our email service provider to ensure that it continues to be safe and secure.

We continue to consult with a number of email service providers to ensure that we keep on top of this issue as it is very important to us. We want to assure our customers that we will continue to monitor this area and take every step to ensure that their email addresses are not compromised or leaked.

Membership Registration
Our site's registration form requires you to provide us contact information and may also require demographic information. Your contact information may be used to contact you when necessary.

Updating Your Personal Information
NZ Rockshops provides you with ways in which you can alter your personal data, including changing your email address, password, phone number, etc.

Control of Your Password
You are responsible for all actions taken with your user name, email address and password. Therefore we do not recommend that you disclose your NZ Rockshops password to any third parties. If you choose to share your user name, email address and password or your information with third parties, you are responsible for all actions taken with this information and therefore you should review that third party's privacy policy.

Membership Removal
If you wish to have your registration removed from our directory for any reason, simply send us an email requesting to be removed. Click here to unsubscribe.

What are Cookies?

Surveillance and Monitoring Policy: Webb Group Locations

You are notified that all Webb Group locations, Nationwide, are monitored by CCTV with images digitally recorded and stored. It is a condition of entry that you consent to the surveillance undertaken by the Company.

Webb Group has strict guidelines around how surveillance and monitoring equipment is utilised: this is used to promote a safe environment by deterring acts of harassment or assault, deter theft and vandalism, assisting in the identification of individuals who commit damage to Company property, to assist law enforcement agencies with regard to the investigation of any crime that may be depicted and to assist in daily operations.
These guidelines, policies, checklists and audits meet the requirements of the NZ Privacy Act 1993.

This Policy applies to all Divisions of Webb Group and in all locations owned, leased, rented or otherwise under the jurisdiction of the Company.

Policy: That only authorised individuals have access to recordings and those recordings will be used solely for the purpose that they were collected, with consent of an individual, or without consent if allowed by law. Surveillance and monitoring equipment will be used only where necessary and appropriate, images will not be altered in any material way, and equipment will be maintained in good working order. An individual’s privacy will be respected in the use of this equipment, which will be stored securely.

Definitions: Surveillance and monitoring equipment includes any item, system, camera, technology or communications device, or process, which is used in conjunction with a network for the purpose of gathering, monitoring, recording or storing an image or images of Company property and/or people in Company facilities. Recordings may be captured in real time or preserved for review at a later date.

Webb Group recognizes the need to strike a balance between the individual’s right to be free from invasion of privacy and the company’s duty to promote a safe environment for all Employees, Customers and its assets.

The Detailed Procedure is available by written request and provided at the discretion of the Company or as otherwise directed or required by designated authorities.


 NZ Rockshop Prize Draw Terms & Conditions
From time to time Webb Enterprises Limited t/a NZ Rockshop (NZ Rockshop) conducts prize draws (Prize Draws).

Note the following:

  • A Prize Draw will be conducted by NZ Rockshop within 14 days of the end of the relevant Promotional Period or as otherwise determined by NZ Rockshop from time to time. The first eligible entry drawn from all entries in the Prize Draw will win the prize, being a prize specified by NZ Rockshop from time to time (Prize).
  • The Promotional Period for a particular Prize Draw is the period specified by NZ Rockshop from time to time.  
  • The winner of a Prize Draw will be notified by phone or email at the number or email address provided on registration. Entrants are responsible for supplying a correct email address. If NZ Rockshop is unable to contact the winner within one month of the Prize Draw (or other specified time) at the phone number or email address supplied, the winner's entry will be declared invalid and the Prize forfeited. If so, NZ Rockshop reserves the right to redraw another winner on the same terms and conditions as the original draw. 
  • NZ Rockshop reserves the right to request proof of registration, payment and/or other entry for a person claiming a Prize.  
  • Winners agree to the use of their name, image and photograph(s), by NZ Rockshop, for publicity and promotional purposes, without compensation. NZ Rockshop will own copyright in any such images and photograph(s) and in all material incorporating the photograph(s);  
  • Prizes are not transferable or exchangeable for cash. In the event that a Prize becomes unavailable for reasons beyond NZ Rockshop's control, NZ Rockshop may substitute a prize of equal value.  
  • Employees of NZ Rockshop and corporate entities are not eligible to enter Prize Draws or to win Prizes.
  • NZ Rockshop reserves the right not to award a prize (and to select an alterative winner) if NZ Rockshop is aware or has reasonable grounds to believe that a winner is not eligible or has breached any of the Terms and Conditions.  In the event that any entrant is disqualified from the Competition, Rockshop at its sole discretion may decide whether a replacement should be selected. 
  • Neither NZ Rockshop nor any other person associated with a Prize Draw shall be liable for any loss or damage whatsoever suffered (including but not limited to indirect or consequential loss or loss of profits and including loss caused by negligence) or personal injury suffered or sustained in connection with either participation in a Prize Draw or the use of any Prize offered, except for any liability which cannot be excluded by law.  
  • If for any reason NZ Rockshop considers that a Prize Draw is not capable of running as planned, NZ Rockshop reserves the right in its sole discretion to cancel, terminate, modify or suspend the Prize Draws.  
  • NZ Rockshop reserves the right to cancel or amend these terms and conditions at any time without prior notice. Any changes will be deemed to be incorporated into these terms and conditions.  
  • NZ Rockshop’s decision in relation to any aspects of a Prize Draw is final and binding.
