Terms and Conditions of Use / Consumer Warning

General Information

Listed below are a few pointers that my help with the use of the website ... enjoy.

Browsing - most of the site is set up as a virtual shopping cart / ordering system. So most of the product pages can be accessed from the links provided by the Search Engines.

- not all products are available all the time. The site is as much an information site as it is an ordering site. Some high end products may need to be ordered from the manufacturer and this can take up to 90 days or more in some cases.

- nothing is purchased by clicking on the Add button, all this does is add the product to a shopping basket. There are two more steps that need to be completed before the list can be sent to us.

 

Website Terms - various terms used on this site.

- E & OE - Errors and Omissions Excepted. We endeavour to keep all information as accurate as possible - however errors will occur from time to time, due to the large scale and nature of our business. Please feel free to query any information by using the Contact Us page above, or the link at the bottom of each product page. All prices will be confirmed, and errors noted, prior to completion of a sale.

- RRP - Recommended Retail Price (where one exists) : As set by the official supplier in NZ. All prices are in NZ dollars and include GST.

- RSP - Rockshop Sale Price : The price we sell this item for. All prices are in NZ dollars and include GST. Some items might be discounted as part of a price special, others may be discounted due to being end of line, shop-demo, floor-stock, missing parts or minor damage. This will be noted where possible

- PRICING - All pricing is manually updated directly from our in-store point of sale system. Updates are scheduled for Mon, Wed, Fri however as prices can be adjusted internally on a daily basis pricing, disparities can occur. The point of sale system is the governing factor in pricing disparities, errors and omissions excepted.

- POA - Our website shows “up to date” stock and pricing for product that is currently on hand. However, due to the vast number of products available to us, and our various supply arrangements, we may have run out of stock or be awaiting re-stocking at that time. In order to keep our listings “live” on the web our system will log these items as POA [Price or Product on Application]. In addition, there might be items awaiting arrival or undergoing re-pricing, or we may not have the latest available price from our supplier. Again these will show as POA.


Finance Pricing / Weekly Figures
- the weekly figure is calculated on a 12, 24 or 36 month term, with no deposit, a $50 booking fee, interest rate of 19.4%
and a $2.50 per month administration fee.

-Figures are indicative only and may differ slightly from actual figures which will be confirmed on finance contract at the time of purchase.

-Insurance is recommended as it offers further, specific cover that your household insurance may not cover.

Finance 0% Interest Promotions - from time to time special 0% interest finance promotions are run. These will be advertised on our website.

-1. Minimum purchase $300.

-2. Subject to Normal Lending Credit Criteria: all the normal checks and requirements of any contract.

-3. Booking Fee Applies: [ for example : normal $55 booking fee ]

-4. Proof of insurance is required for the HP Agreement (only if the CPI-Consumer Protection Insurance available is not taken) i.e. a copy of your policy or advisement from your insurer.

-5. The promotion runs from [ for example : 7th September – 31st October, 2009].

-6. Excludes all Apple & Bose products. The Rockshop reserves the right to exclude some clearance items or already discounted products from this promotion.

-7. On conclusion of the 12 month 0% interest period, normal interest charges apply.

 

Purchasing Terms of Trade - purchases may be made by credit card or direct credit. For the direct credit, we will return email you with a bank account number and a reference code. Goods will be dispatched on the clearance of funds into our account.

NB : Goods purchased for business use are not subject to the Consumer Guarantees Act (CGA) 1993. This includes, but is not limited to, Schools, Churches, Hospitality Industry, Professional Musicians, Studios and any other Institutional purchases. This exclusion also applies for goods purchased for re-sale, or for use in repairs. The explicit written Rockshop warranty then applies. Professional musician is defined as any musician paid for any performance, of any nature.

- All credit card sales are New Zealand Only, Overseas ordering is dealt with on a case by case basis due to manufacturer restrictions, and freight issues. Please give full contact details when ordering.

- All online credit card sales are approved by our secure credit card system provider (DPS). An online approval is the first step in a two step process. Once the final details of the transaction are completed and the goods are shipped, the sale is then completed by a Rockshop staff member.

- All orders received that are over $100 may be confirmed: so a relevant contact number and / or email address must be supplied. This is to avoid the possibility that a credit card number has been obtained without the owners knowledge or consent.

- All confirmed orders are dispatched same day, stock levels permitting. You will be notified of any potential delays at the earliest possible time.

- Most orders will be subject to an additional freight charge, which you will be notified of by the order confirmation phone call. Due to the volume of stock we courier / freight, we offer exceptional courier rates which you are able to take advantage of.

- In the unlikely event that an item arrives damaged, you must contact us immediately. Freight claims arising from damage must be reported to the courier company by us,. in the appropriate format, within seven (7) days of delivery. If you do not contact us within this time, a claim can not be made and no claim will be recognised.

- The reverse of your invoice contains all your warranty information. The details on the front of the invoice are what have been used to identify you in our system. If there is a spelling mistake, or an administration mistake, please contact us immediately so that it can be rectified. Please click here to download a PDF version of the reverse of our invoice.

 

Legal - While Webb Enterprises (T/A NZ Rockshop Group, hereinafter referred to as NZ Rockshops, The Rockshop or NZ Rockshop Group) has endeavoured to take all reasonable and appropriate care in the preparation of the content of this website and has no reason to believe that any information contained on this website is inaccurate, NZ Rockshop does not warrant the accuracy, adequacy, or completeness of such information, or that such information is error free.

- NZ Rockshop does not undertake to keep this website updated. NZ Rockshop does not accept liability for any loss or damage which may result either directly or indirectly from reliance by you upon the accuracy or currency of information contained on this website including without limitation, where such loss or damage is a result of or contributed to, by the negligence of NZ Rockshop.

- Details contained on this website relevant to Goods have been prepared in accordance with New Zealand law and may not satisfy the laws of any other jurisdiction. We do not warrant that the details on this website concerning those Goods will satisfy the laws of any other jurisdiction. It is your responsibility to determine whether these details satisfy the laws of the jurisdiction where you reside (if that jurisdiction is outside New Zealand). If the details do not satisfy the laws of your jurisdiction, you may not order any goods from this website.

- Whenever you access this website, NZ Rockshop may collect the following types of information from you:

1. The IP address of your machine when connected to the Internet and the domain name from which you are accessing the Internet;
2. The operating system and the browser your computer uses and any search engine you are using;
3. The date and time you are visiting;
4. The URLs of the pages you visit, as well as any other information you may explicitly provide in the course of accessing the website such as your name, gender, email address and other personal details such as telephone number.

Freight - Interbranch/International The Rockshop is proud of the brands and lines we stock. We have -by far- the biggest, and most extensive, selection of musical equipment available in NZ. However, not all brands, models, types and colours can be represented in every store: These need to be shipped from one location to another. Occasionally, your specific requirements cannot be met by items we have in stock and a special order may be appropriate.

Moving gear around is expensive. Rockshop makes this facility available to anyone, recouping a modest amount where necessary to cover our costs on product that is already competitively priced.

Following are some basic “guides” as to what our freight policies if goods are needed urgently (ie 24-72hrs) :

1 - If you wantsto BUY something that has to be freighted in and you pay the TOTAL price upfront - then Rockshop will get it in for you freight free UNLESS:

* it's an already discounted item in which case the freight charge still applies; or
* it is a special order and you have requested an urgent (airfreight) delivery; or
* it is very large or requires special handling

2 - If you simply want to VIEW something that has to be freighted in, you pay the freight to get it in: This is called a “Transfer Fee” and it may be refundable on purchase. The client will be separately invoiced for the Transfer Fee at the time of the order.

3 - If you decide to purchase the goods, then the Transfer Fee (freight charge) is refunded off the purchase price (unless the goods are already discounted). If you decide not to purchase, or the goods are discounted, the Transfer Fee (freight charge) is not refundable.

4 - If you have paid freight but DECIDE TO BUY something else, then the Transfer Fee (freight charge) is not refundable.

5 - You have the option of waiting until the item comes in on a regular re-stocking shipment or palleted shipment: In most cases, there will be no freight charge. However, as not all items are carried by all branches, this offer may not be available, or there may still be a freight charge.

Freight - Website The website online ordering system uses a guide for pricing out freight on orders, however different items have different costs and the deals will be dealt with individually.

You will contacted if there is a cost increase on your order.

If there is a refund on the freight charge, it will be issued to you where appropriate.

Freight charges are noted as 'FREIGHT AND PACKAGING' on your invoice and cover the freight cost as well as the packaging and sending of the goods.
